Right of withdrawal within 14 days for distance trading

According to the legal provisions, the buyer has the right to withdraw from the contract concluded at a distance, respectively to return a purchased good, within 14 calendar days, without invoking any reason and without incurring costs other than those of delivery. Thus, according to GEO no. 34/2014, the period for returning a good expires within 14 days from:

  • the day on which the buyer takes physical possession of the last good - if the buyer orders multiple products in a single order that will be delivered separately;
  • the day on which the buyer takes physical possession of the last good or the last part - in the case of delivery of a product consisting of several lots or parts.

The right of withdrawal for distance commerce is not applicable to legal entities because they do not have the status of a consumer.

When returning products, the following general conditions apply:

  • Products must be in the same condition as received.
  • Along with the products, it is mandatory to return all the original documents with which the product was delivered.
  • The product must be accompanied by the accessories with which it was delivered.
  • If several products of the same kind have been purchased and all products are to be returned, you must ensure that only one of them has been unsealed. The return of the other products is accepted only if they are sealed.
  • Products on which unauthorized interventions have been carried out are not accepted for return. Also, products that show signs of wear or excessive use, scratches, bumps, mechanical shocks or products that are missing the accessories they were delivered with are not accepted.
  • The collection of the products will be refused if the return package contains products different from those in the return request.
  • Return costs are borne by the consumer.
  • The delivery cost paid when purchasing the product is not refundable.
  • For orders paid in cash on delivery, the amount will be returned by bank transfer to an account opened in the buyer's name within 14 days of accepting the return.
  • For orders paid by card, the amount will be returned to the same card used for the transaction within 3-30 days after the return is accepted.
